    5. When registering for accommodation services, the User undertakes to enter (provide) accurate personal data and information that is true.
    6. The Offer takes effect upon its approval by NAMETY. The period for accepting this Public Offer is unlimited.
  4. Payment Procedure
    1. NAMETY services, including additional services, are provided to the User for a fee in accordance with the terms of the Agreement and the rates/prices shown on information boards, in the consumer information area, menus, price tags, price lists and other NAMETY information materials. The rates/prices for NAMETY services and the list of services are determined and changed solely at NAMETY’s discretion.
    2. The right to receive/use NAMETY Services is granted after the Guest has paid for the relevant Services in accordance with the Rates/Prices.
    3. NAMETY may set prices at its discretion and apply a system of discounts for temporary accommodation services.
    4. Payment for NAMETY services may be made in cash, by Visa or Mastercard bank card, or by bank transfer.
    5. At the end of the paid accommodation period, the User must leave the room and remove their personal belongings and luggage no later than 12:00 Kyiv time (check-out time) on the last paid day of temporary accommodation, or pay to extend their stay in the room, provided that the room has not been booked by third parties.
    6. Temporary accommodation Services (check-in) begin at 15:00 Kyiv time.
    7. Early check-in and late check-out are additional services charged according to the selected room category at the prices shown on information boards, in the consumer information area, price lists and other NAMETY information materials.
  5. Check-in Procedure. Early Termination of Accommodation Services at the User’s Request.
    1. Accommodation is provided to the User on a prepaid basis, upon payment of 100% of the cost of temporary accommodation services for the period agreed with reception, at the prices shown on information boards, in the consumer information area, price lists and other NAMETY information materials. At the same time, the User must present identification documents to reception (a Ukrainian citizen’s passport, including an international passport; a birth certificate for persons under 16 years of age who are not accompanied by parents, guardians, etc.; a passport of a foreign citizen or stateless person; a migration card), and complete and leave at reception a User questionnaire in the prescribed form.

If the above documents are not provided, the User acknowledges the right of the reception employee to refuse temporary accommodation services.

    2. If the User cancels a booked service or changes its start and/or end date for any reason beyond NAMETY’s control, a change to the service terms at the User’s request after payment is treated as cancellation (partial cancellation) of the service, and a penalty equal to 100% of the cost of the service for one day is retained (charged) in favour of NAMETY.

The following special terms apply to cancellation of temporary accommodation bookings, including changes of dates that are treated as cancellation under this clause, and take precedence over the general rule in the preceding paragraph. If NAMETY reception receives the User's cancellation notice more than 7 (seven) days (168 hours) before check-in, the full amount paid for the cancelled accommodation will be refunded to the User. If the notice is received 7 (seven) days (168 hours) or less before check-in, a penalty equal to the price of the first night's accommodation agreed at the time of booking will be withheld from the amount paid for the cancelled accommodation, but will not exceed the amount actually paid for that accommodation. The balance will be refunded to the User. No additional payment of the penalty beyond the amount actually paid is required.

The notice period is calculated from the time NAMETY reception receives the cancellation notice until 15:00 Kyiv time on the agreed check-in date, in accordance with clause 4.6 of this Public Offer. For the purposes of this clause, 7 (seven) days means 168 hours.

This penalty does not apply if the cancellation results from a breach of contract by NAMETY. These special terms apply subject to section 6 of this Public Offer and do not restrict the mandatory consumer rights established by Ukrainian law, including Articles 13 and 18 of the Law of Ukraine on Consumer Rights Protection.

    3. The special terms of this clause apply to cancellation and rescheduling of sauna, bathhouse and hot tub bookings and take precedence over the general rule in the first paragraph of clause 5.2 of this Public Offer.

If NAMETY receives the User's cancellation notice more than 24 (twenty-four) hours before the agreed start of the session, the amount paid for the cancelled session will be refunded in full. If the notice is received 24 (twenty-four) hours or less before the session starts, a penalty of 50% of the price of the cancelled session agreed at the time of booking will be withheld, but will not exceed the amount actually paid for that session. The remaining amount will be refunded to the User. No additional payment of the penalty beyond the amount already paid is required. Preparation, filling and heating costs will not be charged in addition to this penalty.

For the purposes of this clause, a no-show occurs when the User, without giving notice of cancellation, does not attend the booked session and does not use the service at any point during the entire booked period. The same amount is withheld for a no-show as for cancellation 24 hours or less before the session.

The notice period is calculated from the time NAMETY receives the notice through the communication channel specified in the booking confirmation until the agreed session start time in Kyiv time. Changes to the time or date requested by the User are handled under the cancellation and new booking rules, unless the parties agree terms more favourable to the User.

If NAMETY cancels the booking or cannot provide the booked service, the amount paid for the service not provided will be refunded in full without this penalty. Rescheduling in this situation is possible only with the User's consent. The penalty also does not apply if cancellation results from a breach of contract by NAMETY. These terms apply subject to section 6 of this Public Offer and do not restrict the mandatory consumer rights established by Ukrainian law, including Articles 13 and 18 of the Law of Ukraine on Consumer Rights Protection.

  6. Force Majeure
    1. In the event of force majeure circumstances, including war, floods, earthquakes, fires, strikes, epidemics, changes in legislation, etc., the Parties are partially or fully released from the performance of their obligations under this Agreement.
    2. A Party that becomes unable to perform its obligations due to force majeure circumstances must notify the other Party in writing of the time when those circumstances begin and end.
    3. The occurrence of force majeure circumstances must be confirmed by the relevant competent authority.
  7. Accommodation for Children
    1. No temporary accommodation charge is payable for one child (two children in a Suite) aged up to and including 2 years staying in a room in addition to the permitted number of occupants for the relevant room category.
    2. Persons under 18 years of age may not share a room with persons aged 18 or over, except where they are related, proof of which the Guest must provide upon reception’s first request, or where notarised written consent has been given by the mother, father, guardian or guardianship and custody authority.
    3. The terms for receiving and accommodating groups of children accompanied by adults are determined individually in each case by signing a separate agreement.

Scooters or bicycles may only be provided to persons aged 18 or over, with the number provided based on the number of people staying in the room under the accommodation services. Scooters or bicycles are issued to and returned by Users under a handover certificate. From the moment a scooter/bicycle is received, the User bears full financial liability for its damage or loss. If a scooter/bicycle is lost, the User must reimburse its value within 3 calendar days, but no later than the check-out date. Compensation for loss is determined according to the market value stated in the handover certificate. Compensation for damage to a scooter/bicycle is determined according to the repair estimate and must be paid by the User within 3 calendar days, but no later than the check-out date.
